Terms
Terms of use.
These cover elk.work and the Elk apps and services while Elk is invite-only. If your company has signed an agreement with Elk, that agreement wins where the two differ.
“Elk”, “we” and “us” mean the company that makes Elk. “You” means the person using it, and the company you use it for when you use it for work. Using elk.work or Elk means you accept these terms. If you use Elk for a company, you confirm you may accept them for it.
elk.work
You may read and link to elk.work freely. Its words, images and design are Elk’s; do not copy them to present as your own or to suggest Elk endorses you. What the site records about visits is on the privacy page.
Your account
- Elk is invite-only and opens in waves. An invitation is for the person it was sent to.
- Keep your sign-in to yourself. You are responsible for what happens under your account, including what agents you connect do with the access you give them.
- Tell us at legal@elk.work if you think someone else has used your account.
Your workspace and your data
- What your team puts into Elk, and the records Elk reads from the sources you connect, stay yours.
- You give Elk permission to store and process that data to run Elk for your workspace, as the privacy page describes. Nothing more.
- Connect only sources and credentials you are allowed to use. Each tool’s own terms still apply, and you are responsible for following them.
- Elk is not yet set up to hold health information. Do not connect a source that carries it unless Elk has signed a business associate agreement with you.
Agents and AI
Elk’s agents gather, summarize, propose and, where you allow it, act. They can be wrong. Check their work before you rely on it, and treat what they write as a draft, not professional advice. You decide what they may do without asking, and you are responsible for the changes you approve or allow to run.
Fair use
Do not use Elk or elk.work to:
- break the law or someone else’s rights;
- reach data in a workspace you do not belong to, or test Elk’s security without our written permission;
- overload, disrupt or work around the limits of the service;
- copy, resell or reverse engineer Elk, except where the law allows it regardless of these terms;
- send malware, spam, or content you have no right to share.
Fees
Fees, if any, are set in the order or agreement you sign with Elk. Without one, there are none.
Elk changes
Elk is early and changes often. Features may change, move or be removed. Without a signed agreement there is no uptime commitment; the current state of Elk’s services is at elkstatus.work.
If you send us feedback or ideas, we may use them without owing you anything for them.
Ending
You can stop using Elk at any time and ask us to close your workspace. We may suspend or end access that breaks these terms or puts other workspaces at risk, and we will tell you why unless the law or someone’s safety prevents it. What happens to your data when a workspace closes is on the privacy page.
Warranty and liability
While Elk is invite-only, it is provided as it is, without warranties of any kind, to the extent the law allows. To the same extent, Elk is not liable for indirect, incidental or consequential losses, or for lost profits or data, and Elk’s total liability under these terms is limited to the greater of what you paid Elk in the twelve months before the claim and 100 US dollars.
Changes to these terms
When these terms change in a way that matters, the date at the top changes, and people with an Elk account hear about it before the change applies. Using Elk after that means you accept the new terms.
